Regulations

I. Definitions

Seller - Talia Aldona Roszak, Firma Odzieżowa, ul. Trzebiatowska 29, 60-432 Poznań; NIP: 781-100-34-67, REGON: 632475113, entered in the Central Register and Information on Business Activity of the Republic of Poland kept by the Minister of Economy, e-mail: office@talia-fashion.pl , tel./fax: +48 61 8488 091 (referred to in these Regulations as Talia);

Orderer - a person (Customer) placing an Order in the Talia Online Shop and a party to the Sales Contract if it is concluded; Talia Online Shop - the ICT sales platform operating at https://www.talia-fashion.pl, operated by Talia, through which the Orderer can purchase Goods from the Seller;

Customer - a natural person, a legal person or an organisational unit without legal personality but with legal capacity, who, on the principles set out in these Regulations, makes or intends to make an Order or uses other services of the Talia Internet Shop (including a consumer within the meaning of Article 221 of the Act of 23 April 1964 of the Civil Code, i.e. Journal of Laws of 2014, item 121, as amended);

Goods - movable items, presented in the Talia Online Shop, which may be the subject of a Sales Contract;

Sales Contract - a distance sales contract concluded between the Seller and the Ordering Party to the extent of the Goods indicated in the Order and on the terms and conditions specified in these Regulations;

Working days - all days of the week from Monday to Friday, excluding public holidays;

Basket - an element of the Talia Online Shop by means of which the Customer specifies details of the Order, such as the quantity of the Goods, size and colour of the Goods, delivery address, invoice details, method of delivery, method of payment, etc;

Registration Form - a service available on the Talia Online Shop website, by means of which the Customer, by providing his/her personal data, creates a user account with which he/she can purchase Goods from the Talia Online Shop;

Order Form - a service available on the Talia Online Shop website, by means of which a Customer without a user account can purchase Goods from the Talia Online Shop;

Talia Company Stationary Store - a traditional retail outlet located in a shopping centre or other location;

II. General provisions

(1) The TALIA online shop is operated by the Seller.

(2) Each Customer can access the Terms and Conditions at any time by "clicking" on the "Terms and Conditions" link located on the Online Shop website.

By placing an Order, the Customer simultaneously declares and confirms that he/she has read and accepted these Terms and Conditions. Acceptance of the Terms and Conditions is a necessary condition for using the services of our Online Shop.

(3) All information contained on the Talia Internet Shop website relating to the Goods (including prices) does not constitute a commercial offer within the meaning of Article 66 of the Civil Code, but constitutes an invitation to conclude a contract as defined in Article 71 of the Civil Code.

(4) Photos of Goods are placed on the Talia Online Shop website for exemplary purposes and are used to present the models specifically indicated in them.

5 Customers are able to purchase Goods from the Talia Online Shop regardless of whether they have registered by completing the Registration Form and creating a profile.

Registration in the Shop is tantamount to acceptance of the Terms and Conditions.

6) Effective placement of an Order is conditional on: providing accurate and true address data by the Customer as indicated in the Order Form or Registration Form, as well as indicating a telephone number or e-mail address at which the Seller will be able to contact the Customer.

(7) The information provided in the Registration Form and the Order Form should be truthful and up-to-date. If the information provided is untrue or outdated, which applies in particular to the Customer's personal data, the Seller is not obliged to carry out the Order. It is forbidden for the Customer to provide or make available content that is contrary to the law or infringes the rights of third parties.

(8) The Seller does not provide mechanisms for verifying the correctness of data entered by the Ordering Party, other than mechanisms for checking their completeness. The Ordering Party may at any time correct his/her errors when entering data into the Order.

(9) The Seller shall take the necessary technical and organisational measures to prevent acquisition and modification by unauthorised persons of the data provided by the Customer during registration and Order placement. (The rules for the protection of personal data provided by the Customer are set out in Chapter XII. Personal Data and in the Privacy Policy).

10. The customer is obliged in particular to:

a) use the services offered by the Seller in a manner that does not disrupt the functioning of the Internet Shop, in particular by using specific software or devices;

(b) not to take any action to come into possession of classified information held by the Seller;

c) use of the services offered by the Seller in a manner compliant with the provisions of the law in force in the Republic of Poland, the provisions of the Terms of Use, as well as with the customary practice in a given field;

(11) The Seller may deprive the Customer of the right to use the Online Store if false data is provided in the Registration Form or Order Form or in the event of a breach of the obligations referred to in paragraph (10) above. A Client who has been deprived of the right to use the services of the Online Store may not register again without the prior consent of the Seller.

III. Goods and availability

(1) All Goods offered in the Talia Online Shop are new, manufactured in Poland by the Seller based on his designs.

2 Every piece of our Goods is created through our careful work. All Goods are refined and finished by hand, making each piece unique and unrepeatable. Therefore, slight variations and irregularities are inherent in our Goods.

The photographs of the Goods are placed on the Talia Online Shop website for exemplary purposes and are used to present the models specifically indicated therein.

It is permissible for differences to exist between a copy of the same design of Goods, the photograph of which has been posted on the Talia Online Shop, and another copy of that design of Goods ordered by the Customer, the difference in detail of Goods of the same series being due to the specifics of the manufacture of those Goods.

The Seller reserves the possibility of changes in the colours of the Goods resulting from the difference in the colours shown in the photograph of the Goods and the original photographed Goods.

Furthermore, the Seller reserves the possibility of slight variations in the colours of the Goods due to differences in the colours of the same material supplied to it by its suppliers.

Photographs and other forms of visualisation and presentation of the Goods placed on the pages of the Online Shop are for information purposes only about the Goods.

The Goods presented in our Online Shop are available in a very wide range of colours. Due to its richness, the palette of all colours available in the Online Shop is presented in the pictures of the various Goods.

In the description of each Goods, information on the availability of the Goods in a given colour and size is given.

(4) Goods displayed in our Online Shop may be modified according to the Customer's wishes. We are then dealing with an Individual Order. A list of modifications is provided next to each item. Each modification requires our separate approval and is priced separately, so it is necessary to contact us by phone or email before placing an Order.

Nor do we accept all alterations.

We do not accept returns of Goods from individual orders - made-to-measure, shortened and altered.

(5) The Goods presented in our Online Shop have varying availability, which is dependent on the fulfilment of orders from our material suppliers and the Seller's production process. In the event that some of the Goods included in the Order are not available, the Customer is informed of the status of the Order and decides on the manner of its fulfilment (partial fulfilment, extension of the waiting time, cancellation of the entire Order).

(6) The Seller undertakes to supply the Customer with Goods that are new and without defects.

IV. Prices of Goods and Promotions

1 All prices of Goods displayed on the website of the Talia Online Shop:

a) include VAT and are given in Polish zloty;

b) do not contain information on shipping costs, which are calculated and communicated to the Customer before the Order is finally accepted by the Customer;

(2) Prices presented in Euro are only approximate and result from the conversion of prices in PLN according to the current exchange rate of the National Bank of Poland. The Talia online shop is not responsible for the exchange rate at which the card issuer will convert the price into the currency in which the card is held.

(3) The binding and final price of the Goods shall be the price of the Goods as shown on the Talia Online Shop website at the time the Customer places the Order.

(4) Information on the total value of the Order, including shipping costs, shall be displayed on the Website after the Customer has selected the form of delivery of the Order and the form of payment (see Section VI and VII).

(5) Any modifications to the Goods made at the Customer's request will affect the final price of the Goods. These are priced separately, after prior contact with the Customer.

(6) Talia reserves the right to make changes to the prices of the Goods on offer on an ongoing basis and to conduct and cancel all types of promotional actions and sales. The right referred to in the preceding sentence shall not affect Orders placed prior to the effective date of the change in price, terms and conditions of promotional actions or sales, and they shall be executed on the previous terms and conditions.

7 Promotions in the Talia Online Shop are not cumulative unless otherwise stated in the terms and conditions of a particular promotion.

8 The prices of the Goods applicable in the Talia Company Online Shop shall apply when placing an Order via the Internet on the Website https://www.talia-fashion.pl, by telephone and by e-mail. When making purchases at the Talia Company Stationary Store, the prices specified for Goods sold directly at the Talia Company Stationary Store shall apply.

All special offers presented on the Website https://www.talia-fashion.pl are valid while stocks last. A limited number of Goods are intended for promotional sales and sales. Orders are fulfilled in the order in which orders for these Goods are received. Due to the limited availability of the Goods included in the promotion, Talia shall not be liable for unfulfilled promotional orders.

9. Promotional actions do not include Goods from Individual Orders - made-to-measure, shortened and altered.

V. Placing an Order and Concluding a Sales Contract

1 In order to purchase the Goods presented in the Talia Online Shop, an Order must be placed.

(2) An order can be placed on the Talia online shop website (using the Order Form or the Registration Form ), by telephone on +48 61 8488 091, as well as by e-mail at office@talia-fashion.pl .

(3) Orders placed on the Talia Online Shop website are accepted 24 hours a day, on all days of the week. Only Orders placed by telephone and e-mail are accepted on working days between 10.00 a.m. and 6.00 p.m. Orders placed on public holidays will be processed on the first working day following the day on which the Order was placed.

(4) If the Customer has registered with the Talia Online Shop, the Order is placed by logging on to the Talia Online Shop website, adding the Goods to the shopping basket and confirming the intention to place the Order.

If the Customer has not registered with the Talia Online Shop, the condition for placing an Order is to add the Goods to the shopping cart, to fill in in the Order Form all the required data necessary for the dispatch of the Goods and to take other technical actions based on the messages or information displayed to the Customer.

(5) When placing an Order, the Customer selects the Goods, indicates the size and colour of the Goods, if the Goods are offered in different sizes and colours, adds the Goods to the Basket, and then indicates in the Basket the method of collection and payment for the Order.

Before completing the Ordering procedure, the Customer declares and confirms that he or she has read and accepted these Terms and Conditions, and confirms that he or she is aware that the Order of Goods is tantamount to the obligation to pay.

If the customer has opted for payment on delivery then the obligation is at the time of collection.

(6) The Order placement procedure ends with sending the Order. Submission of the Order by the Customer constitutes the Customer's offer to the Seller to conclude the Sales Agreement, in accordance with the content of the Terms and Conditions.

(7) By placing an Order in our Online Store, the Customer accepts the conditions placed in the description of the Goods, in particular their availability in a given colour and size, the price, the shipping costs and the processing time for the Order. Only Orders complying with the conditions placed in the description of the Goods shall be treated as a correctly placed offer.

(8) After the Order has been sent, the Customer shall receive a message on the Talia Online Shop website and at the e-mail address indicated by the Customer, confirming that the Order has been placed. The confirmation message sent to the e-mail address contains information on the items in the Order, the quantity of Goods, the value of the Order, the selected type of delivery and payment, and the Customer's contact details. The message displayed on the Shop's website informs about the number and amount of the Order and provides data for transfer. Confirmation of the Order constitutes confirmation of receipt by the Seller of the Customer's purchase offer.

(9) The Customer shall receive a confirmation of acceptance of his/her offer by e-mail (Confirmation of Order Acceptance for Fulfillment), to the e-mail address provided by the Customer. Upon receipt of the aforementioned confirmation, the Contract of Sale of the Goods ordered by the Customer is concluded.

(10) The contract of sale shall be concluded in the Polish language and shall be in accordance with these Terms and Conditions.

11. the Customer has the right to make changes to and cancel the Order no later than within 2 days of receipt of the Seller's confirmation of acceptance of the purchase offer, i.e. before receiving the e-mail confirming acceptance of the Order for processing. In this case the Customer should immediately contact the Seller by e-mail or telephone (after which the confirmation should be sent by e-mail). Cancellation of Orders paid by online transfer/credit card is not possible.

VI. Methods of payment

1. Payment for the Ordered Goods can be made:

a) by bank transfer or payment into a bank account

b) online transfer/credit card - payment made in real time, through the use of payment methods indicated in the Online Shop directly by the Seller or an entity acting on behalf of the Seller;

The order is fulfilled subject to the Seller obtaining positive authorisation from the electronic payment operator and the Buyer's bank.

Payment card and e-transfer transactions are settled via Przelewy24 - PayPro S.A..

c) cash on delivery - payment made at the time of handover of the parcel, sent by DPD courier company.

We do not send Goods from Individual Orders on delivery.

We do not send cash on delivery abroad.

d) on collection in person at the Seller's premises;

(2) The payment term shall be determined by the form of payment chosen by the Purchaser. With the exception of cash on delivery, payment shall be made after the conclusion of the Contract of Sale and before delivery and issue of the Goods.

(3) If the Seller's bank account has not been credited with the amount due within 7 calendar days from the date of approval of the Order, the Sales Agreement concluded between the Ordering Party and the Seller shall be terminated.

(4) The e-mail confirming the Order shall state the exact amount to be paid including the shipping charge and any discounts.

The cost of additional services, modifications to the Goods carried out at the Customer's request is quoted separately, in a separate correspondence, to be paid prior to the performance of the aforementioned service.

VII. Delivery

1 The Goods are delivered to the address indicated by the Customer when placing the Order.

(2) Delivery of the Goods shall take place on the territory of the Republic of Poland via DPD Polska Sp. z o.o. courier company. The maximum expected delivery time of the Goods by the carrier is 2 working days from the date of shipment. Talia reserves the right to change the service provider delivering the Goods.

Third Delivery of the Goods outside the Republic of Poland is carried out through the Polish Post Office S.A. (economy shipment) and the courier company DPD Polska Sp. z o.o. (express shipment).

The expected delivery time of the Goods depends on the type of consignment selected and can range from 4 to 21 working days.

We only send goods by express mail to Germany, Austria and the Czech Republic. Express shipment to other countries - only after prior telephone or e-mail contact. Cost to be determined individually.

Talia reserves the right to change the service provider delivering the Goods.

Orders shipped outside the territory of the Republic of Poland may be subject to zone fees, customs fees and import taxes, if any. These charges shall be borne by the Customer. We are not responsible for delays caused by customs procedures.

(4) It is recommended that the Customer, upon receipt of the parcel with the Goods, checks its condition. In case of any damage or violation of the packaging, it is advisable to draw up a damage report in the presence of the courier, which, together with a possible complaint, should be immediately sent to the Seller, no later than within 3 days.

5. delivery charges for the Goods are stated in the Ordering process.

VIII. Processing of orders

(1) Once the Ordering Party has received confirmation of acceptance of the offer, the process of execution of the Order by the Seller begins.

(2) Completion of the Order shall be understood as completion of the Order and transmission for dispatch via carrier to the address indicated by the Ordering Party.

3 Orders are processed in the order in which they are received until stocks are exhausted.

(4) The approximate period for the fulfilment of Orders is from 1 to 5 working days from the date of booking of payment or from the date of obtaining positive authorisation from the electronic payment operator and the Buyer's bank. In the case of Cash on Delivery Orders, from 1 to 5 working days from confirmation of acceptance of the Order.

5 Realistic lead times for Orders depend on current stock levels, the production process, the execution of Orders with our material suppliers and promotions and the quantity of Goods per Order.

(6) If Talia cannot fulfil the Order due to the unavailability of the ordered Goods (or lack of some of the ordered Goods), Talia shall notify the Customer without delay, but at the latest within three days of the date on which the Customer places the Order, in order to decide on the manner of its fulfilment (partial fulfilment, extension of the waiting time, cancellation of the Order in its entirety), if it has received payment, it shall return the entire sum of money received from the Customer.

7 The lead time for Orders for customised Goods (manufactured especially for the Customer, according to his/her specifications) is determined individually.

(8) Each consignment is accompanied by a proof of purchase (VAT invoice or receipt). If the Purchaser is a VAT payer and wishes to receive an invoice, he/she should send the relevant information to the Seller, e.g. via e-mail immediately after the purchase, providing the necessary data.

IX. Replacement of Goods

1 All Goods purchased from the Talia Online Shop are exchangeable within 14 days of delivery.

(2) If the Customer does not like the size/colour, he/she may exchange the Goods for the same one in a different size/colour. If the size/colour the Customer is interested in is not available, the Customer may exchange the Goods for another size/colour available in the Talia Online Shop.

(3) Exchanges should be addressed to: Talia Aldona Roszak, Clothing Company, 29 Trzebiatowska Street, 60-432 Poznań.

Please insert a card with the information in the package with the exchanged Goods:

* indication of the Target Goods (Goods name, size, colour)

* exchange address.

(4) The cost of sending back to Talia the unused Goods shall be covered by the Customer. On the other hand, the cost of postage after an exchange is made is free of charge and covered by the Seller (this applies to a one-time exchange).

(5) The cost of replacing Goods sent abroad - both ways shall be borne by the Customer.

If the Goods purchased as a result of the exchange is more expensive than the returned Goods, the Customer shall pay the difference in price to the Seller's bank account. The title of the transfer shall include the order number. If Talia's bank account is not credited with the agreed amount, the exchange will not be implemented.

If the Goods purchased as a result of an exchange are cheaper than the Goods returned, Talia shall, within 14 days of delivery of the Goods to be exchanged, refund the difference in price to the Customer's bank account.

X. Right of withdrawal from the Sales Contract/Return of Goods

(1) The Customer shall have the right to return the Goods purchased from the Talia Online Shop (withdraw from the Contract of Sale) without giving any reason within 14 days from the date of receipt of the Goods.

(2) The above right may be exercised by the Customer by sending a written declaration of withdrawal from the Sales Agreement to the address: Talia Aldona Roszak, Firma Odzieżowa, ul. Trzebiatowska 29, 60-432 Poznań, and sending back the Goods together with the proof of purchase.

3. Zwracany towar musi być w stanie niezmienionym.

(4) The relevant model form of the Sales Agreement Withdrawal Declaration is attached as Annex No. 1 hereto.

However, a declaration by the client on a simple piece of paper stating:

"I withdraw from the Sales Contract concerning the following items:

............................................................................................................ order number ................................. purchased via www.talia-fashion.pl .

Please transfer the amount concerned ....................... to the bank account given below.

Signature and legible personal details, address and account number to be reimbursed."

(5) In the event of cancellation of the Goods, the money will be refunded to the Customer by transfer to the bank account specified in the declaration within a maximum of 14 days.

The Customer shall bear the costs of returning the returned Goods.

The Customer is not entitled to return the Goods at the Seller's expense. In the event that the Goods are sent at the recipient's expense, the price to be refunded to the Customer shall be reduced by the return delivery costs paid by the Seller.

7. Jeśli konsument odstępuje od umowy, ponosi on odpowiedzialność za zmniejszenie wartości towaru będące wynikiem jego korzystania w sposób wykraczający poza konieczny do stwierdzenia charakteru, cech i funkcjonowania towaru.

(8) The Customer shall not have the right to withdraw from the Sales Agreement in relation to contracts in which the object of performance is an item produced to the Customer's specifications or intended to satisfy his/her individualised needs.

We do not accept returns of Goods from Individual Orders - made-to-measure, shortened or altered.

XI. Complaints (notification of non-conformity of the Consumer Goods with the contract)

Complaints should be submitted to the address: Talia Aldona Roszak, Clothing Company, 29 Trzebiatowska Street, 60-432 Poznań.

When lodging a complaint, the Goods in question should be delivered to the Seller together with the proof of purchase and the complaint notification (the complaint notification should include: contact address, e-mail address and telephone number, date of purchase of the Goods, description of the defect giving rise to the complaint, date and circumstances in which the defect was found, the complainant's request, signature).

We do not accept parcels sent back cash on delivery.

3 Only latent defects caused by the manufacturer may be claimed.

The Seller shall consider the complaint within 14 days from the date of receipt of the complaint and shall notify the complainant of the result of the complaint consideration in writing or by e-mail to the e-mail address provided in the complaint or by text message to the telephone number provided.

(5) If the complaint is resolved in favour of the Customer, the Seller shall repair or replace the Goods complained of with new, full-value Goods, and if this proves impossible, offer a reduction in price or return the value of the Goods purchased.

(6) If the complaint is not accepted, the Goods will be sent back to the Customer together with an opinion as to whether the complaint is unfounded.

XII. Personal data

(1) The administrator of the personal database of customers of the Talia Internet Shop is the Seller.

2 Data collected for the purpose of order processing and shop information policy: Name, e-mail address, telephone number, home address, delivery address, possibly company data (Name, address, VAT number).

(3) The provision of personal data by the Customer when placing an Order is voluntary, however, without providing such data, purchases in the Talia Internet Shop are not possible (concerns data marked as obligatory).

By providing this data, the Customer agrees to the storage and processing of the Customer's personal data by the Seller for the purpose of performing the Sales Agreement and fulfilling the Seller's legal obligations, e.g.: issuing and storing invoices and accounting documents, performing returns and exchanges of goods, responding to complaints within the time and form stipulated by law.

(5) The personal data in question may be entrusted for processing to entities engaged in the delivery of Goods (entities engaged in postal or courier activities), with the proviso that the scope of this entrustment may not exceed the data necessary for the delivery of Goods to the Customer.

The personal data in question may also be entrusted for processing to entities carrying out payment activities (banks, payment institutions) - in order to make refunds to Customers.

The Seller may disclose personal data to third parties who perform legal obligations on the Seller's behalf, such as issuing and storing invoices and accounting documents.

(6) Each Customer registered in the Talia Online Shop shall have the right to access the information provided by him/her which constitutes personal data within the meaning of the General Data Protection Regulation "RODO" (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC) and to rectify them, and furthermore he/she has the right to control the processing of the information he/she has provided which constitutes personal data under the terms of this Regulation, including in particular the right to request, in the cases listed in this Regulation, in writing, the restriction of the processing, the cessation of the processing of his/her data due to his/her particular situation and the right to object to the processing of his/her data in the cases listed in this Regulation.

(7) The Vendor shall provide appropriate technical and organisational measures to ensure the security of the personal data provided by the Ordering Party, in particular to prevent access by third parties or their processing in violation of the law, to prevent data loss, damage or destruction.

(8) The Customer may consent to receive, at the e-mail address or telephone number provided by the Customer, commercial information from the Seller. Such consent also includes the possibility to use automated calling systems for direct marketing purposes in accordance with Article 172(1) of the Act of 16 July 2004. Telecommunications Law (Journal of Laws No.171 item 1800 as amended).

(9) The customer has the right to lodge a complaint with the President of the Personal Data Protection Authority if he/she considers that the processing of his/her personal data violates the law.

XIII. Terms and conditions of the Talia Gift Cards

I. Definitions

  1. Publisher - Talia Aldona Roszak, Firma Odzieżowa, ul. Trzebiatowska 29, 60-432 Poznań; NIP: 781-100-34-67, REGON: 632475113, entered in the Central Register and Information on Business Activity of the Republic of Poland conducted by the Minister of Economy;
  2. Talia online shop - an ICT sales platform operating under the address https://www.talia-fashion.pl, operated by Talia, through which the User can purchase Goods from the Seller;
  3. Gift Card- an Electronic Gift Card fixed in digital form (numerical code/gift code) allowing the User to pay for Goods on the Talia Online Shop;
  4. Purchaser - a person who, in the Talia Online Shop, transfers funds to the Issuer in an amount equal to the value of the Gift Card, in return for which he or she receives a Gift Card from the Issuer;
  5. User - the Purchaser or any holder of a Gift Card presenting it for redemption in the Talia Online Shop;
  6. Goods - items offered for sale in the Talia Online Shop.

II. General provisions

  1. Gift Cards are available in the following denominations: PLN 100, PLN 200, PLN 300, PLN 500, PLN 1000.
  2. The Publisher may introduce Gift Cards of other denominations without amending these Terms and Conditions.
  3. The Gift Card can only be purchased and redeemed in the Talia Online Shop.
  4. The issuing of the Gift Card by the Publisher to the Purchaser shall only take place through its purchase in the Talia Online Shop. The Publisher undertakes to provide the Purchaser with the Gift Card of the specified denomination and then to accept it for redemption.
  5. In exchange for the Gift Card received, the Purchaser undertakes to transfer funds to the Issuer in an amount equal to the nominal value of the Gift Card concerned. Payment for the Gift Card can be made using one of the payment methods available in the Talia Online Shop. The cash on delivery payment option is not available.
  6. The funds transferred to the Issuer by the Purchaser in accordance with paragraph 5 above shall become the property of the Issuer in full when the Gift Card is issued.
  7. The value of the Gift Card expressed in PLN (Polish Zloty) is equal to the amount contained therein.
  8. A Gift Card cannot be purchased with a second Gift Card.
  9. No discount codes work with the purchase of the Gift Card.
  10. The Gift Card is valid for a period of twelve months from the date it is issued to the Purchaser. When the Gift Card is issued to the Purchaser, it is activated (a Gift Card not activated by the Issuer is invalid). The validity of the Gift Card cannot be extended.
  11. The Gift Card can only be redeemed after activation in the Talia Online Shop, which takes place after the purchase has been finalised.
  12. Once payment has been credited, an email will be sent to the email address provided by the Purchaser with a graphic for self-printing the Gift Card and an active numeric/gift code with the value of the Gift Card.
  13. The purchaser is obliged to provide a correct e-mail address for the delivery of the gift card. The publisher is not responsible for an incorrectly provided e-mail address.
  14. The User is obliged to read and comply with these Terms and Conditions before redeeming the Gift Card.

III. Use of the Gift Card

  1. The Gift Card can only be used by natural persons with full legal capacity during the validity period of the Gift Card.
  2. The Publisher will inform the User that the Gift Card:
    1. can only be realised in the Talia Online Shop;
    2. is not convertible into cash;
    3. has an expiry date after which it cannot be redeemed (the Gift Card is valid for 12 months from the date of issue).
  3. The user redeems the Gift Card by entering the Gift Card number code in the Talia Online Shop in the shopping basket at the end of the purchase. The code reduces the value of the shopping cart. The code from the Card does not reduce the value of the delivery, only the value of the Goods.
  4. When the User enters into a contract for the sale of Goods with the Publisher by presenting the Gift Card for redemption, the amount of money accumulated on the Gift Card will be fully allocated to cover the price payable to the Publisher for the Goods sold.
  5. In the event that the price of the Goods purchased by the User using the Gift Card is higher than the amount on the Gift Card, the User shall be obliged to pay the difference by another form of payment, with the User's Talia Online Shop being bound by the payment methods indicated therein.
  6. In the event that the price of the Goods purchased by the User using the Gift Card is lower than the total amount for the Goods purchased, the difference will not be refunded. Unused Gift Card funds will be saved in the form of a new code. The code will be sent to the User's designated email address.
  7. We are not obliged to reimburse to the person redeeming the Gift Card any amounts for differences between the gross price of the goods issued and the face value of the Gift Card.
  8. The Gift Card is a disposable card. When making a purchase using the Gift Card, the User is required to enter the numerical code found on the Gift Card. The code provided is a single-use code.
  9. The issuer has the right to refuse to redeem the Gift Card after the expiry date of the Gift Card.
  10. The Gift Card is not exchangeable for cash.
  11. The Publisher shall not be liable for Gift Cards that are lost after they have been issued to the Purchaser.
  12. In the event of loss or theft of the Gift Card, the user has no claim against the issuer.
  13. In the event that the amount contained in the Gift Card remains unused despite the expiry date of the Gift Card, the user is not entitled to claim a refund from the issuer.
  14. In the event of cancellation of a sales contract covering Goods purchased in the Talia Online Shop using a Gift Card pursuant to Article 27 of the Consumer Rights Act of 30 May 2014 (i.e. Journal of Laws of 2019, item 134), the User will receive a new Gift Card from the Publisher, corresponding to the value of the amount of the previous Gift Card. If the price of the purchased Goods exceeded the value of the Gift Card and the User paid the difference using another payment method, the amount will be refunded by the Publisher to the User's account. The Talia Gift Card issued by the Publisher to the User in accordance with the provision of this paragraph will have a validity period of twelve months from the date of issue.

IV. Complaints

  1. Any complaints in relation to the Gift Cards will be dealt with by the Issuer in writing within 30 (in words: thirty) days from the date of the User's written complaint.

V. Withdrawal from the contract (return of the Gift Card)

  1. A purchaser who has acquired a Gift Card via the Online Shop, Talia may withdraw from the contract without stating any reason within 14 days of taking possession of the Gift Card (receipt of the email with the active Gift Code), by submitting an appropriate declaration of withdrawal to the Issuer. To do so, send an email with the Statement and the account number for the return. There is no need to send us the Card. The Gift Card code will be cancelled.
  2. If the Gift Card has been used in whole or in part by the date on which the withdrawal period expires, the Publisher will not refund the Purchaser the amount equivalent to the value of the Gift Card that has been redeemed.
  3. By withdrawing from the Gift Card agreement, the Purchaser undertakes not to use the Gift Card until the Gift Card code has been cancelled. If, in the period between the declaration of withdrawal from the Gift Card agreement and the cancellation of the Gift Card code, the Purchaser has redeemed the Gift Card, the Publisher will be released from the obligation to reimburse the Purchaser the amount paid for the issuance of the Gift Card.

VI. Final provisions

  1. Any matters not covered by these Terms and Conditions will be governed by the relevant provisions of the law, including in particular the provisions of the Civil Code and the Act.
  2. The Gift Card is not an electronic payment instrument, it is not an e-money instrument or a payment card.
  3. The issue of the Talia Gift Card to the User does not constitute a sale subject to value added tax within the meaning of the relevant tax regulations. The User will receive, at the time of payment, a written receipt (accounting note) not constituting a fiscal receipt or VAT invoice.
  4. The Issuer reserves the right to amend the Gift Cards Terms and Conditions in the event of any organisational or legal changes to the Issuer and its business activities, changes to the applicable legislation applicable to the Terms and Conditions and changes to the functionality of the Talia Online Shop applicable to the Terms and Conditions. The amended terms and conditions of the Gift Cards Terms and Conditions will be made available on the website waist-fashion.co.uk.
  5. The Publisher reserves the right to suspend or terminate the issuance of Gift Cards at any time without giving any reason. The publisher will inform the users of the Gift Card programme about the suspension or termination through the website www.talia-fashion.pl
  6. Users of Gift Cards acquired up to the date of suspension or termination of the programme will be able to use them under the existing terms and conditions.
  7. The rules for the purchase of Goods in the Online Shop are regulated in the rules of the Talia Online Shop located at the following address: Terms and conditions - Talia Fashion (talia-fashion.pl)

XIV. Final provisions

(1) Nothing in these Terms and Conditions is intended to infringe the rights of the Customer. Nor can it be interpreted in this way, since in the event of any part of the Terms and Conditions being inconsistent with applicable law, the Seller declares its absolute compliance with and application of that law in place of the challenged provision of the Terms and Conditions.

(2) Each Customer can access the current Terms and Conditions at any time by "clicking" on the "Terms and Conditions" link located on the Talia Online Shop website.

(3) Each Customer is obliged to read the Terms and Conditions and is bound by the provisions of the Terms and Conditions in each case at the time of placing an Order, whether via the Talia Internet Shop operating at https://www.talia-fashion.pl, by telephone (+48 61 8488 091) or by e-mail at: office@talia-fashion.pl .

(5) The Seller reserves the right to amend these Terms and Conditions at any time. Amendments to the Terms and Conditions are binding for the Customer from the moment of their acceptance while logging in to the Online Shop (applies to Customers who have registered to the Online Shop). Amendments to the Terms and Conditions do not apply to Orders placed prior to such amendment; the Order is then fulfilled on the basis of the provisions of the Terms and Conditions in force at the time the Order was placed by the Customer.

(6) The Seller shall not be liable for transactions carried out by unauthorised third parties who have gained access to the Customer's account in the Shop as a result of the Customer losing or disclosing the login or password to such account.

(7) In matters not covered by these Rules, the relevant applicable legislation shall apply.

(8) Disputes, if the Customer so wishes, shall be resolved by mediation proceedings before the Provincial Inspectorate of Trade Inspection or arbitration court at the Provincial Inspectorate of Trade Inspection or by equivalent and lawful methods of pre-court or out-of-court dispute resolution indicated by the Customer. As a last resort, the case shall be settled by the court having jurisdiction over the Seller's registered office.

These Regulations shall enter into force on 25.05.2018.
